When President Obama signed the latest version of the National Defense Resources Preparedness Executive Order on Friday, March 16, it caught a number of people by surprise who didn’t realize that presidential administrations have been creating Executive Orders for decades strengthening the government’s power to control the country’s natural resources, land, infrastructure and people under the argument of national defense and emergency preparedness.

Presidents have refined the original act put in place since 1938 by President Franklin D. Roosevelt (EO 8248, http://www.archives.gov/federal-register/codification/executive-order/08248.html) which was originally started to survey, collect data, analyze problems pertaining to national resources and to make recommendations to the President and Congress or long-term plans and programs "for the wise use and fullest development of such resources."

In 1994, President Clinton signed Executive Order 12919, National Defense Industrial Resources Preparedness, a document similar to the current incarnation President Obama updated and signed. This order gave remarkable powers to the federal government to take possession and control over private property and resources. http://www.archives.gov/federal-register/executive-orders/pdf/12919.pdf Executive Order 12919, President Bill Clinton, 1994

Here is the version signed by President Obama on March 16, 2012.

The Order has been superseded a number of times, starting in 1951 by nearly every President through Bill Clinton, and amended twice by George W. Bush.

Hotair.com has some more in-depth analysis about the latest update of this Executive Order, with the broad conclusion that this order is nothing new, but rather updates existing delegation of authority with more current nomenclature, granting no new authority to the President or Cabinet that they don’t already have under existing law: "National Defense Resources Preparedness" executive order: Power grab or mere update?" We could not find a discussion on the constitutionality of these martial law orders to take control over private property.
