International Paper agrees to $1.15 million settlement
Over aquifer water pollution issue at Libby mill site

The City of Libby has reached an agreement with International Paper over the aquifer water pollution issue. The City will receive $1.15 million in a lump sum as a make up payment for the ten years the City allowed payments from International to lapse.

In addition the City will receive $250,000 each year for 10 years and a ten year option to continue the payments. The 1.15 million and the first $250,000 payment begin July 1 and payments for future years are subject to adjustment for inflation escalation.

International Paper must give one year notice at the end of the first ten years if they do not wish to continue the payments.

The City has agreed in return to maintain the ordinance prohibiting drilling wells within the City boundaries as defined in 1986.

The money goes into the water department budget.

The settlement is the result of liability inherited by International Paper from previous owners following decades of wood preservative from the pole treating plant at the mill leaching into the aquifer.
